Supervisor Bartlett led the pledge of allegiance. He called for a roll of members present. All members were present. Legal Counsel Joseph W. Russell was present.
MOTION #98
Supervisor Bartlett made a motion to adopt the minutes of September 10, 2015
Councilman Rich seconded the motion.

MOTION # 99
Supervisor Bartlett moved to adopt the minutes of the September 17, 2015 special meeting. Councilman Desormo seconded.

Supervisor Bartlett opened a scheduled public hearing at 7:03 PM. A public hearing for local law # 5, “tax cap override”
No one chose to speak therefore Supervisor Bartlett closed the public hearing at 7:04 PM.
Supervisor Bartlett opened the floor for anyone wishing to address the Town Board.
No one chose to speak, he then closed the floor.
There was no Town Clerk’s correspondence.
Supervisor Bartlett acknowledged receipt of the Town clerk’s report for the month of
September 2015.
MOTION #100
Supervisor Bartlett, moved to acknowledge that the board had received the proposed budget as presented, and scheduled a work session for 7:00 PM October 22, 2015 at the Town Municipal Building 22867 Co. Rt. 67, Watertown, N.Y. Councilman Rich seconded.

Supervisor Bartlett informed the board of the changes to the proposed budget as it was presented.
RESOLUTIONS:
MOTION #101
WHEREAS, the N.Y.S. Office of Justice Court Administration provides grant assistance to municipalities through the Justice Court Assistance Program, which provides funding for Justice Courts with large volumes of case loads, and
WHEREAS, an application for a grant to fund purchases for the town justice court office equipment and for other improvements will be submitted with authorization from the Board.
THEREFORE BE IT RESOLVED, the Town of Watertown Council hereby authorizes an application to the Court Assistance Program for funding the requested purchases and improvements for the Town of Watertown Justice Court.
Supervisor Bartlett moved the foregoing resolution and Councilman Prosser seconded.

MOTION #102
WHEREAS, Local Law No.5 of the Year 2015, a Local Law to override the tax levy limit established by Section 3-C of the New York General Municipal Law was introduced by a member of the Town Board at a meeting thereof held on September 17,2015, and by a majority vote of the Town Board members present at such meeting, a public hearing was duly scheduled to consider Local Law No. 5 of 2015 for October 1, 2015 at 7:00 PM, and
WHEREAS, notice of the public hearing was duly published and posted as required by law, and on October 1, 2015, at 7:00 PM, a public hearing was duly held to hear all persons interested in the subject matter of Local Law No. 5 of 2015.
NOW, THERFORE, be it resolved by the Town Board of Town of Watertown as follows:
1. the foregoing recitations are incorporated herein and made a part hereof as if fully set forth hereafter.
2. As a result of unfunded mandates and other anticipated municipal expenses beyond the ordinary control of this Board, the tax levy limits imposed by Section 3-C of the General Municipal Law put unrealistic constraints on this Board in establishing a prudent and responsible budget for the 2016 fiscal year.
3. Local Law No.5 of the year 2015 authorizes, but does not require the Town of Watertown in establishing its budget for the 2016 fiscal year to establish a tax levy in excess of the amount otherwise authorized by Section 3-C of the General Municipal Law.
4. Based upon the foregoing Local Law No.5 of the year 2015 is in the best interests of the Town of Watertown, is hereby adopted and the clerk is instructed to file the same with the New York State Departments of State.
5. The adoption of Local Law No.5 of the year 2015 is a Type II action under the provisions of the State Environmental Quality Review Act and the regulations promulgated thereunder.
Supervisor Bartlett moved the foregoing resolution and Councilman Rich seconded.
The motion was duly adopted upon a roll call vote of the Town Board as follows.

Supervisor Bartlett described Aviagen North America motion that follows. The Town Board had several questions and it was discussed by the Board.
MOTION #103
WHEREAS, Aviagen North America, Inc. which operates the hatchery located within the Jefferson County Industrial Park has requested a PILOT agreement wherein Aviagen proposes to undertake a project to renovate its existing building and to convert it from a boiler hatchery to a breeder hatchery on land within the Industrial Park as described in Schedule “A”, attached, and
WHEREAS, the taxing jurisdictions which are collectively, the Town of Watertown, Jefferson County and the General Brown Central School Districts have the obligation and authority to each and all concur with any Payment in Lieu of Tax agreement proposal wherein each taxing jurisdiction will receive a reduction in property tax revenue in furtherance of job retention, creation and development for a period of 15 years.
THEREFORE BE IT RESOLVED, the Town of Watertown Council acting on behalf of the Town of Watertown hereby agrees to the JCIDA issuance of a Payment in Lieu of Tax Agreement for the period stated.

MOTION #104
WHEREAS, a special street lighting district has been formed to include all parcels located within the Jefferson County Industrial Park located within the Town of Watertown on N.Y.S. Rt. 12 F wherein each parcel within the district boundary will share in the benefits of street lighting being constructed by National Grid, and
WHEREAS, the costs for usage of the district is to be born solely by the parcels located within the district boundary, and
WHEREAS, parcel No. 73-20-1-14 will receive no benefits from the district because of the parcels location along the river and outside the Industrial Park, and
WHEREAS, parcels 82-08-1-5.1 and 82.08-1-5.2 are located along county route 200 and will benefit from the lighting district.
NOW THEREFORE BE IT RESOLVED, that the Town Council acting as administrators for the IDA Park Lighting District hereby authorizes the removal of parcel No. 73.20-1-14 from the district description, and authorizes the inclusion of Parcel Nos, 82.08-1-5.1 and 82.08-1-5.2 as beneficiaries of the district.

MOTION #105
WHEREAS, it is necessary to amend the fiscal Year 2015 Budget to balance appropriation accounts in order to provide an accurate record of appropriations.
THEREFORE BE IT RESOLVED, the Supervisor is authorized to amend the Fiscal Year 2015 Budget as follows.

Under old business Councilman McAtee asked the status of the water tower located in the Industrial park. Supervisor Bartlett said that the company had been contacted and would begin the demolition very soon.
Supervisor Bartlett discussed that the town needed to inventory all of its fixed assets.
It was noted that the Tug Hill Commission could possibly help with this service. .
No new Business.
