Supervisor Joel Bartlett called for a roll call of members present. All members were present except for Councilman Paul Desormo.
MOTION # 94
WHEREAS, at a regular meeting of this Board held at the Town offices on the 6th day of July, 2015, an Order of this Board was duly adopted and entered in the minutes of the proceedings reciting in general terms the filing with the Town Clerk of the Town of Watertown of a plan and report prepared by GYMO Architecture, Engineering & Land Surveying, P.C. (“GYMO”) for the proposed extension of Water District No. 4 within the Town of Watertown, reciting the boundaries of the proposed District extension, the improvements proposed, that the cost to construct such improvements shall be borne by the owner of the single parcel that encompasses the extension, and specifying that a public hearing shall be held to hear all persons interested in the proposed expansion of Water District No. 4 at 7:00 p.m. on August 13, 2015, and
WHEREAS, a copy of the aforementioned Order of this Board was duly and regularly published in the official newspaper for the Town of Watertown and certified copies thereof were posted on the official sign board of the Town of Watertown as required by Article 12-A of the Town Law, and
WHEREAS, a public hearing was duly held pursuant to the aforesaid Order at the Town offices, 22867 County Route 67, Watertown, New York on August 13, 2015, at 7:00 p.m., and all persons interested in the proposed extension were provided an opportunity to be heard, and
WHEREAS, following the closing of the public hearing this Board voted unanimously to adopt certain findings and determined to extend Water District No. 4 as presented by GYMO, and
WHEREAS, within ten (10) days following the adoption of the aforesaid Resolution, the full text of the Resolution together with a notice setting forth the date of the adoption thereof and the fact that the resolution was adopted subject to a permissive referendum was published in the official newspaper of the Town of Watertown and posted as required by law, and
WHEREAS, more than thirty (30) days have elapsed since the adoption of the Resolution, and no petition protesting against the Resolution has been properly submitted to the Town Clerk of the Town of Watertown, and the Town Clerk has caused to be filed pursuant to Section 209-e(4)(a) of the Town Law a certificate certifying that no petition was filed requesting a referendum, and
WHEREAS, the permission of the State Comptroller is not required pursuant to Section 209-f of the Town Law.
NOW, THEREFORE, upon a motion duly made, and seconded, this Board hereby makes the following Order:
1. ORDERED that the aforesaid recitations are incorporated herein as if fully set forth hereafter, and it is further
2. ORDERED that the extension of Water District No. 4 as described in the plan and report prepared by GYMO and on Schedule “A” attached hereto and made a part hereof is finally established and the providing of the services thereof as described therein is hereby authorized, and it is further
3. ORDERED that the Town Clerk of the Town of Watertown shall cause a certified copy of this final Order of the Town Board to be duly recorded in the Office of the Clerk of the County of Jefferson, within ten (10) days after its adoption, and to file a certified copy thereof with the Department of Audit and Control within ten (10) days following its adoption.
A motion to adopt the foregoing Order was made by Supervisor Joel Bartlett and seconded by Councilman Stephen Rich and upon a roll call vote of the Board was duly adopted as follows:

ALL THAT TRACT OR PARCEL OF LAND situate on the north side of U.S. Route 11 and the northeast side Gillette Road in the Town of Watertown, County of Jefferson, State of New York and being further described as follows:
BEGINNING at a 5/8 inch iron pin found. in the northerly highway margin of U.S. Route 11 at the most southerly corner of a 5.659 acre parcel of land that was conveyed to M.A. Moid Khan by deed dated October 22,1987 (Liber 1094, page 315);
THENCE from said point of beginning south 73 degrees 16 minutes 52 seconds West along the northerly highway margin of U.S. Route 11 a distance of 10.38 feet to a concrete highway marker found at an angle point in said margin;
THENCE continuing along the highway margin of U.S. Route 11 North19 degrees 51 minutes 39 seconds West a distance of 12.17 feet to a concrete highway marker found at another angle point in said margin;
THENCE continuing along the highway margin of U.S. Route 11 South 73 degrees 16 minutes 52 seconds West a distance of 112.26feetto a point in the pavement centerline of the Gillette Road, said point being situate northwesterly along the pavement centerline of Gillette Road a distance of approximately 64.0 feet from a nail found in the pavement centerline of U.S. Route 11;
THENCE northwesterly along the pavement centerline of Gillette Road as it curves sharply to the left a distance of approximately 230.0 feet to a PK nail set at an angle point in said centerline;
THENCE continuing along the pavement centerline of Gillette Road North 65 degrees 07 minutes 38 seconds West a distance of 502.24 feet to another angle point in said Gillette Road and at the most easterly corner of a 1.456 acre parcel of land that was conveyed to Griffith Oil Company, Inc. (Liber 1444, page 214);
THENCE continuing along the pavement centerline of Gillette Road North 64 degrees 57 minutes 06 seconds West a distance of 50.70 feet to a point;
THENCE North 43 degrees 22 minutes 27 seconds East a total distance of 558.38 feet to a 1/2 inch iron pipe set at the most northerly corner or the parcel of land herein described and passing on line at 50.35 feet a 1/2 inch iron pipe set;
THENCE South 65 degrees 07 minutes 38 seconds a distance of 511.75 feet to a 1/2 inch iron pipe set in the northwest line of the above referenced 5.659 acre Khan parcel of land;,
THENCE South 73 degrees 16 minutes 52 seconds West along the northwest line of Khan a distance of 275.00 feet to a 5/8 inch iron pin found at the most westerly corner of Khan;

Supervisor Bartlett introduced proposed Local Law # 5 -2015, a Local Law to override the Tax Levy Limit established by Section 3-C of the New York General Municipal Law. The hearing will be held at 7:00 PM, October 1, 2015 at the Town of Watertown Municipal Building, 22867 Co. Rt. 67, Watertown, NY 13601. All persons wishing to speak for or against this proposed resolution shall be heard. Councilman Prosser seconded this resolution..
